Hire agreement terms & conditions
Please read the terms and conditions of this hire agreement before you hire the big red party bus from us and check that they contain everything which you want and nothing that you are not willing to agree to.
Your attention is particularly drawn to clauses 4 (Your obligations) and 12 (Limit on our responsibility to you) of these terms and conditions.
We are letting and you are taking on hire of the bus (i.e. The Big Red Party Bus) including each item of equipment and all renewals, replacement and additions to the bus, on the terms and conditions set out in this agreement. Where there are two or more of you, each of you is separately responsible for performing both your own obligations and those of your co-signatories under this agreement.
2. Right to cancel this contract
2.1 You have the right to cancel this agreement within 14 days without giving any reason.
2.2 The cancellation period will expire after 14 days from the day of the conclusion of the agreement (i.e. the date you sign the order form attached to these terms and conditions).
2.3 To exercise the right to cancel, you must inform us of your decision to cancel this agreement by a clear statement (eg a letter sent by post or email). You can also complete the cancellation form below:
2.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
2.5 We will wait until the 14-day cancellation period in this clause 2 is over before we will deliver the goods or start to carry out any services, unless:
2.5.1 you want us to hire the bus to you and/or carry out the services during the 14-day cancellation period;
2.5.2 we have agreed to do so; and
2.5.3 you have submitted a waiver form below.
Written confirmation to deliver the bus and start carrying out services within the 14 day cancellation period.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that in most cases, you can cancel the contract within 14 days. This may happen because you change your mind.
By signing this written confirmation and giving it to our representative, you agree that, on your request, we can deliver the bus and start to carry out any related services during the 14-day cancellation period.
You still have a right to change your mind and cancel the contract during the 14-day cancellation period, however, we will charge you for the cost of delivery/hire and any services carried out by us until the time when you tell us that you want to cancel the contract. The amount we charge you will be in proportion to what we have carried out, in comparison with the full coverage of this contract.
You acknowledge, however, that you will lose the right to change your mind and cancel the contract during the 14-day cancellation period once you have hired the bus. If this happens, we will charge you for the full cost of hire
By completing the waiver form below I/We hereby give notice that I/We request you to supply the big red party bus.
3. Effects of cancellation
3.1 If you cancel this agreement under your rights set out in clause 2 above, we will reimburse to you all payments received from you except where we are allowed to keep such payments such as hire fees for any period of hire or where we have started carrying out any services within the 14-day cancellation period and you have signed our written confirmation to start carrying out the services within the 14-day cancellation period (see clause 2.5 for more details).
3.2 We will make the reimbursement without undue delay, and not later than 14 days after t the day on which we are informed about your decision to cancel this agreement.
3.3 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
3.4 If you have hired the bus:
3.4.1 we will collect the bus without undue delay from the day on which you communicate your cancellation from this agreement to us;
3.4.2 you may be charged the cost of the collection; and
3.4.3 you are liable for any diminished value of the bus resulting from your use of the bus other than what is necessary to establish the nature, characteristics and functioning of the bus.
3.5 We may make a deduction from the reimbursement for loss in value of the bus, if the loss is the result of unnecessary use by you.
4. Your obligations
4.1 You shall:
4.1.1 Make payment
Pay the reservation fee within 7 days of signing the contract and the hire fee no later than two weeks before the date of hire (as stated on the order form). Any payment sent to us by post will be at your risk;
4.1.2 Use of Goods
Use the bus properly and in accordance with the guidelines and instructions issued to you, and in particular any health and safety instructions.
You accept that your use of the bus will be unsupervised and that you are responsible for the use of the bus by you and any person you permit to use the bus.
You shall not modify the bus or alter any part of it, not remove or alter or permit removal or alteration of identification or registration numbers or marks on the bus, keep the bus properly protected and safe, and shall ensure that the bus is used safely and without risk to health;
4.1.3 Damage, loss and repair
Be responsible for loss of or damage to or caused to the bus, and replace or repair such loss or damage if so required by us;
4.1.4 Notice of loss
Immediately give notice in writing to us of the happening of any loss of, or damage to, the bus, or of any accidents or injuries caused to any person using the bus;
Allow us access to inspect the bus if so required during your period of hire;
4.1.6 Location of Bus
Keep the bus at the agreed location, and shall not sublet the bus nor, remove or permit the removal of the bus from the location.
A hire deposit of £250 is payable by the hirer after inspection of the bus immediately before the hire session. This is payable by bank transfer or cash. This deposit is fully refundable immediately after the hire session following an inspection of the bus and subject to the bus being clean and undamaged. Part or all of the deposit may be retained at the discretion of The Big Red Party Bus.
5. Further stipulations
5.1 Overdue sums
Notwithstanding that you shall not allow any sum payable by you under this agreement to become 10 days or more overdue, you shall pay us on demand:
5.1.1 interest on sums payable under this agreement which are 10 days or more overdue at the base rate of our bankers from time to time; and
5.1.2 any cost or expense incurred by us in obtaining payment of such arrears.
6. Termination by us
6.1 We may on any breach by you of any of the provisions of this agreement after due notice terminate this agreement, and on such termination this agreement and the hiring constituted by the agreement shall determine and you shall no longer be in possession of the bus with our consent, and, subject to the provisions of clause 7 below, to our right to take repossession of the bus and to any of your pre-existing liabilities to us, neither party shall have any rights against the other.
7. Your liability on termination by us
7.1 If we terminate the agreement, you shall become liable to pay us (in addition to all other sums (if any) in respect of which you shall be indebted to us):
7.1.1 any arrears of hire fees accrued due up to the date of termination;
7.1.2 the cost of all repairs required to be done to the bus to put it in a condition consistent with the performance of your obligations under this agreement; and
7.1.3 damages (if any) for prior breach of this
8. Your privacy and personal information
9.1 We will usually make the delivery of the bus or will provide details of any third party used to deliver the bus. If you want to see information on your delivery options and costs, speak with us before you place your
9.2 Our representative will let you know the estimated date and time window for delivery of the bus. If our representative does not have this information, it will be set out in a confirmation email.
9.3 Delivery of the bus will take place when we deliver it to the address that you gave to us.
9.4 We cannot deliver the bus if we are unable to properly identify you. Please provide our driver with a form of ID (passport or photocard driving licence).
9.5 Unless you and we agree otherwise, if we cannot deliver the bus on the agreed delivery date, we will:
9.5.1 let you know;
9.5.2 cancel your order; and
9.5.3 give you a refund of any payment you have made to us.
9.6 If nobody is available to take delivery, please contact us using the contact details at the top of this page.
9.7 You are responsible for the bus when delivery has taken place. In other words, the risk in the bus passes to you when you take possession of the
10. Faulty goods
10.1 Your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’), are set out at the top of this contract. They are a summary of some of your key rights. For more detailed information on your rights and what you should expect from us, please:

10.2 Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.
11. End of the contract
11.1 If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
12. Limit on our responsibility to you
12.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:
12.1.1 losses that:
(a) were not foreseeable to you and us when the contract was formed;
(b) that were not caused by any breach on our part;
12.1.2 business losses; and
12.1.3 losses to non-consumers.
13.1 We will try to resolve any disputes with you quickly and efficiently.
13.2 If you are unhappy with:
13.2.1 the big red party bus or any part of it;
13.2.2 our service to you generally; or
13.2.3 any other matter,
please contact us as soon as possible.
13.3 If you and we cannot resolve a dispute using our internal complaint handling procedure, we will:
13.3.1 let you know that we cannot settle the dispute with you; and
13.3.2 give you certain information required by law about our alternative dispute resolution provider.
13.3.4 If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have exclusive jurisdiction in relation to this contract.
13.5 The laws of England and Wales will apply to this contract.
14 Third party rights
14.1 No one other than a party to this contract has any right to enforce any term of this contract.
